Sales terms and conditions


    1. Agreement to Terms: By engaging in any transaction with Better Air Manufacturing Ltd, the client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. Any deviation from these terms must be expressly agreed to in advance in writing to be considered valid.

    2. Payment Terms: Our invoices are payable within 21 working days, unless an alternative payment timeframe is explicitly indicated on either the invoice or the order. In case of non-payment by the due date, Better Air Manufacturing Ltd reserves the right to request a fixed interest payment amounting to 10% of the remaining sum due. Late payment may result in the suspension of services without prior warning.

    3. Debt Recovery: If a payment remains outstanding more than sixty (60) days after the due date, Better Air Manufacturing Ltd reserves the right to engage the services of a debt recovery company. All associated legal expenses will be payable by the client.

    4. Withholding Taxes: Certain countries impose withholding taxes on invoice amounts per their internal legislation. The client is responsible for remitting any withholding taxes to the relevant tax authorities. Better Air Manufacturing Ltd, under no circumstances, can be held responsible for costs related to a country's legislation. The invoice amount is due in its entirety to Better Air Manufacturing Ltd and does not include any costs related to the legislation of the client's country.

    5. Service Performance and Obligations: Better Air Manufacturing Ltd commits to delivering high-quality services within the agreed timeframes. However, these commitments do not constitute obligations to achieve specific results. Under no circumstances can Better Air Manufacturing Ltd be compelled by the client to act as a third party in any claims for damages filed against the client by an end consumer.

    6. Claims and Notifications: For any claim to be admissible, Better Air Manufacturing Ltd must be notified within 8 days of the delivery of the goods or the provision of the services. Notifications must be made in writing via recorded delivery to Better Air Manufacturing Ltd's registered office.

    7. Delivery and Shipping:

    7.1 Delivery Process: Better Air Manufacturing Ltd is committed to ensuring timely delivery of products. The delivery process, including shipping methods, estimated delivery times, and associated costs, will be outlined in the order confirmation.

    7.2 Shipping Costs: Shipping costs are specified at the time of purchase and may vary based on the destination, shipping method, and the nature of the products. Any additional fees or taxes related to shipping will be communicated to the client.

    7.3 Responsibilities: The responsibility for shipping and delivery is transferred to the client upon dispatch from our facilities. Any issues with delivery should be promptly reported to Better Air Manufacturing Ltd for resolution.

    8. Returns, Refunds, and Warranty:

    8.1 Return Policy: Clients may request returns within [15] days of receiving the product. Products must be in their original condition and packaging. Better Air Manufacturing Ltd reserves the right to assess the condition of returned items before processing a refund.

    8.2 Restocking Fees: A restocking fee of [10]% may be applied to returned items, and the client will be notified of any such fees before processing the return.

    8.3 Refund Process: Refunds will be processed within [15] days of receiving the returned product. The original payment method will be used for the refund unless otherwise agreed upon.

    8.4 Limited Warranty: Better Air Manufacturing Ltd provides a 1-year limited warranty on its products. This warranty covers manufacturing defects and does not extend to damages caused by misuse or normal wear and tear.     9. Limitation of Liability:

    9.1 Extent of Liability: Better Air Manufacturing Ltd's liability for damages is limited to the total value of the transaction. We are not liable for any consequential, indirect, or special damages incurred by the client.

    9.2 Exceptions: This limitation of liability does not apply in cases of intentional misconduct, gross negligence, or violation of applicable laws.

    10. Force Majeure:

    10.1 Unforeseen Events: Neither party shall be held responsible for delays or failures in performance due to circumstances beyond their reasonable control, including but not limited to acts of nature, governmental actions, labor strikes, or unforeseeable events.

    10.2 Notice: In the event of force majeure, the affected party shall promptly notify the other party of the circumstances and the expected impact on performance.

    11. Changes to Terms and Conditions:

    11.1 Notification of Changes: Better Air Manufacturing Ltd reserves the right to update or modify these terms and conditions. Clients will be notified of any changes via email or through a prominent notice on our website.

    11.2 Acceptance of Changes: Continued use of our services after the effective date of changes constitutes acceptance of the modified terms and conditions.
